Thank you for visiting the Go For
Broke National Education Center's Web site (the "Site").
Access to this site, the home page of which is located at http://www.GoForBroke.org,
is offered to you, the individual user, by the Go For Broke National Education
Center. Please read the following Terms
of Use and Privacy Policy carefully.
Acceptance of Terms
These Terms and Conditions of Use ("Terms") govern
your use of the Site. Limited use of the Site is offered to you
by the Foundation subject to, and conditioned upon your acceptance
of, these Terms. Your use of the Site constitutes your legally binding
acceptance of and agreement to abide by the Terms then in effect.
Under these Terms only, the Foundation grants you a license to view
and use the interactive features of this site. If you do not agree
to these Terms, you are not an authorized user and should discontinue
any use of this site. Furthermore, we reserve the right to change,
modify, add, or remove portions of these Terms at any time without
notice to you. If you continue to use this site after we have posted
changes to the Terms, it means you have accepted those terms.
Description of Service
The Foundation provides users with a Web site with various online
resources including oral history video archive, video clips, searchable
databases, learning center, historical information, and research
information. Unless explicitly stated otherwise, any new features
added to the Site shall be subject to the Terms.
In order to use this service, you
must obtain access to the World Wide Web, either directly or through
devices that access Web-based content, and pay any service fees
associated with such access. In addition, you must provide all equipment
necessary to make such connection to the World Wide Web, including
a computer and modem or other access device.
The Foundation reserves the right
at any time to charge fees for access to portions of the service
or the service as a whole. However, in no event will you be charged
for access to the service unless we obtain your prior agreement
to pay such charges. All fees and charges shall be billed to and
paid for by you. You shall pay all applicable taxes related to the
use of service through your account.
Registration
In order to access the general areas of the Site, you are not required
to register with the Foundation. However, the Foundation does offer
certain features and services where registration is necessary. In
order to register, you are required to accept the terms and conditions
specified in the ORAL HISTORY VIDEO ARCHIVE ACCESS AGREEMENT. You
will then fill out a registration form, either online or in print.
Persons under 18 years of age must have their parent or guardian
sign a printed registration form. After the Foundation receives
your completed registration form, you will receive an email notification
from us containing your password. Additional contact
information gathered by the Foundation is requested for our private
mailing list. All such submissions are governed by the Foundation's
Privacy Policy.
You agree, where information is requested,
to provide true, accurate, current, and complete information about
yourself and not to impersonate any other person. If you select
a password, you are responsible for keeping the password confidential,
and are fully responsible for all activities that occur under your
password. You agree to (a) immediately notify the Foundation
of any unauthorized use of your password or any other
breach of security and (b) ensure that you exit from your account
at the end of each session. The Foundation is not liable for any
loss or damage arising from your failure to comply with this Section.
Privacy Policy:
The Terms incorporate the terms of the Foundation's Privacy Policy.
Please read our privacy policy that
follows, which explains how the Foundation uses the personal information
that the Foundation collects from you. As the Foundation updates
and expands our Web site, this policy may change, so please read
our privacy policy/terms of use periodically for changes. If you

The Foundation may collect personal information from you through
various forms on our Web site. The Foundation values your privacy
and will not sell, trade, or rent any of the personal information
that you provide without giving you notice and an opportunity
to refuse disclosure.
- Cookies: A "cookie" is information contained in a file
that we may place on your computer's hard drive so that we can remember
information about you at a later time when you visit the Site. They
enable the Foundation to track and target your interests while on
the Site and therefore enhance your experience on the Site. Usage
of a cookie is in no way linked to any personally identifiable information
while on the Site. You should also be aware that any organizations
or companies that are linked through the Site may provide their
own cookies. This privacy policy does not cover how these organizations
use their cookies.
- Restrictions on Information Collected: Federal law requires that
Web sites that collect personal information from children under
the age of 18 first get parental consent and that children should
always get permission from their parents before sending personal
information about themselves over the Internet. The Foundation does
not knowingly collect or solicit information from children under
the age of 18. If the Foundation discovers that we have inadvertently
received information from a child under the age of 18, the Foundation
will delete such information from our records.
- Disclaimer and Limitation of Liability with Respect to Information:
There is always a risk when transmitting any information via the
Internet. We do not and cannot guarantee that our system is free
from hackers and viruses or that any information provided by users
to us will not be stolen or otherwise surreptitiously obtained.
You hereby acknowledge and understand that such risk is inherent
with any Web site, including this site, and take full responsibility
for any harm, danger or damage that ensues due to any such breach
in security. Pursuant to these Terms of Use, we expressly disclaim
any such liability.

may release personal information of our users if we believe, in
good faith, that such release is legal and required by law, or
requested by subpoena or court order. The Foundation may also,
in our discretion, release such information to assist investigators,

on this site is owned by the Foundation or used by permission. You

The Foundation expects users of this service to respect the rights

that constitutes a criminal offense;

permission of the owner of such copyright, trademark, trade secret,
right of publicity or other proprietary right. Any person who has
been found repeatedly to violate the intellectual property rights
of others shall be barred from submitting or posting any further

Limitations of Liability &
Warranty
By accessing the Site, you agree
that the use of the Site is entirely at your own risk. The Site
is provided on an "as is" basis without warranties of
any kind, either express or implied.
Furthermore, the Foundation is not
responsible for any third-party content located throughout the Site
including the discussion board(s). You specifically agree that the
Foundation is not liable for any conduct by other third-party users,
including but not limited to: the general site, the message boards,
chat rooms, or any other on-line auditorium.
The Foundation makes no guarantee
of the accuracy, correctness, or completeness of any information
on the Site and is not responsible for: (i) any errors or omissions
arising from the use of such information; (ii) any failures, delays,
or interruptions in the delivery of any content or services contained
within the Site; or (iii) losses or damages arising from the use

Choice of Law
This Agreement shall be constructed

to submit to personal jurisdiction by the state and federal courts
